Great new resource on judicial views on the federal sentencing guidelines
I am happy to know about a spotlight a great new federal sentencing resource created by Professor David Zlotnick, who in recent years has been doing some of the most innovative and important "ground-level" work on federal sentencing reforms. Here is David's own description of his new website:
I am pleased to announce that the website for my federal sentencing project can be now be accessed at this link. The underlying research for this project was funded by a Soros Senior Justice Fellowship grant and was conducted over the past four and a half years. The heart of the work is contained in forty comprehensive case studies of federal cases in which Republican appointees complained that the sentences required by law were excessive. These profiles are the most comprehensively documented cases studies of federal sentencings available on the Internet.
The site also includes a draft of my forthcoming article in the Colorado Law Review, "The Future of Federal Sentencing Policy: Learning Lessons from Republican Appointees in the Guidelines Era." This article contains a blueprint for sentencing reform legislation that might resonate with this cohort of federal judges in the post-Booker era.
The launch of the website this summer is intended to allow my work to be used by sentencing reformers in the upcoming debate in Congress over the Sentencing Commission's proposed changes to the crack cocaine penalties. By showing that Republican appointees share many of the same concerns as academics and criminal defense attorneys, I hope to explode the myth of the liberal federal judiciary and pave the wave for meaningful and bipartisan sentencing reform.

I am just a friend of a poor Mexican American
divorced mother of three boys here in Southern CA.This family has one son in the CA prison system who needs assistance with a federal appeal due by November 27,2007.Manuel Gonzales will spend 24 more years in prison if he does not get a new appeal to the Central Federal Courts of appeal here in LA CA.

For this obvious neglect and allowed abuse of Americas poor prison population being forced by our US Congress to submit their own Federal appeals, Lawyers For Poor Americans declares that the name of Manny Gonzales to be the first official American Poster Child for all the other hundreds of thousands in our US prisons faced with this same daunting and tragic situation ! How could the richest country in the world force our poor and mostly uneducated prison population to reach for outside financial assistance from other World leaders in paying federal appeal lawyers ( to submit their case properly ) so they might get another chance for a retrial ? Manny Gonzales just recently acquired his GED in his prison after 3 years and now is expected to write his own Federal appeal ? We invite all of you to think about being poor and innocent in a US prison faced with this dilemma. According to certain experts 10 % of US prison population is innocent to begin with. The Innocence Project has already proven close to nearly 250 prison inmates did not commit the crime they were accused of after some of these judicial victims were already incarcerated for 25 years or more How can we as Americans continue to allow these other 200,000 innocent American citizens to continue languishing in our prisons without even having an appeal attorney submit proper paperwork on their behalf to a Federal Court ? It appears that the US Supreme Court way back in 1984 knew the injustice of our federal appeal retrial review process really only being available for affluent Americans to get benefit from.The masses of poor and mostly uneducated prison inmates who are being forced to write their own federal appeal legal cases, are being denied new trials by the federal courts in mass all across this country everyday. Some believe this injustice stems way back in our history to pre Civil War era when the US Southern States were railroading blacks into prolonged prison sentences and knowing all along that the Federal Courts would never grant these poor black prison inmates new trials because they never could properly write their own federal appeal legal cases.The real horror here is that this form of injustice is even in 2008 assisting in the prolonged false incarceration of over 100,000 innocent mostly uneducated American prison inmates nation-wide.We all know the federal appeal retrial process was designed for all Americans as a fail safe device that every American should be entitled to utilize, but it is quite obvious that our government has allowed this appeal process to slip into a completely new facade in which it has become an exclusive opportunity for only rich Americans to be able to properly benefit from.

We can all understand that our government has a sticky situation on their hands when it comes to attempting to offer the over 2 million total prison population federal appeal legal representation when the prison experts report there are about 100,000 innocent prison inmates being falsely incarcerated.Many Americans would say that a better way needs to be found to find the 100,000 innocent among the total prison population and focus the needed resources to exonerate them.Our government needs to decide
that these tens of thousands of innocent US prison inmates are worth saving decades of wrongful incarceration.There needs to be leaders who understand how horrible this injustice is and are willing to start to bring about the needed
change to help correct it from continuing to inflict grave harm on our fellow American citizens.

The Innocence Project could use Federal financing for future offices around our country so they can continue to expand their wonderful work freeing the falsely incarcerated American prison inmates who have had the door shut on their attempts to ever be able to properly exonerate themselves with new criminal trials. Having professional lawyers and investigators who can assist these tens of thousands of innocent citizens regain their freedoms should be made a priority by our US Congress. The Innocence Project has already shown us all the reality that the US judicial system is not nearly perfected to always convict and incarcerate the proper defendant. For any of us to continue to easily write off and just forget about assisting the over 100,000 falsely prosecuted and convicted Americans languishing in our prisons nationwide, it would only bring to light that our wonderful democractic society, which takes pride in enjoying the American Dream of life, liberty and the pursuit of happiness, is, unfortunately in this instance, very limiting in its application for those Americans caught in this modern-day hopeless unjust horror.

I'm a little confused as to the ability of our government to allow wealthy Americans the proper opportunity to represent their federal appeal legfal cases with lawyers and forcing poor Americans to attempt this legal feat on their own?
Obviously the federal appeal judicial legal process was created for all Americans to be able to utilize if the need should ever arise.All Americans support this federal appeal retrial
legal process with their tax dollars and for our
wealthy citizens to be the only real benefactors of this judicial process,makes me wonder if it can be challenged in the US courts ?

I totally agree that the Manny Gonzales federal appeal legal case before the Central CA Federal District Court in Riverside California is the exact same type of unjust legal situation black Americans faced after being falsely incarcerated for decades in the US Southern States pre Civil War Era. Pretending that our Federal appeal judicial process properly administers equal justice to all these tens of thousands of poor and mostly uneducated prison inmates nationwide who are forced to represent their own Federal appeal legal cases themselves, is just a facade for all of us to believe that Americans would also never abandon 100,000 innocent fellow citizens who have been falsely incarcerated in our prison systems nationwide!

This situation being talked about with improper legal assistance being afforded our poorer prison inmates really baffles me.Manny Gonzales I read
is in need of federal appeal legal fees so he could submit a proper legal case to the Federal appeal court and if he does not get the monies,
he will have to attempt this feat himself? No wonder the prison experts are saying this country has so many innocent in our prisons.If this kid Manny Gonzales is reflective of the rest of our judicial system across the nation,we may just need the Innocence Project in every major American

I read that this denial of proper legal counsel afforded poor prison inmates concerning Federal Appeal retrials dates back to pre Civil War era and find it incredible that it has been allowed to continue in our civilized society.This Manny Gonzales criminal retrial case obviously is just the tip of the iceberg when were talking 100,000 reported innocent Americans being falsely incarcerated in our US prison systems.I also read that President Hugo Chavez of Venezuela has been requested to pay the Federal appeal legal fees for Manny Gonzales? When we have our poor from our prisons asking others around the world for attorney legal fees,we must have a very serious
problem facing our judicial system.

A friend told me about the Manny Gonzales federal appeal legal issue being talked about in certain government circles,and I just wanted to comment, that I also agree that everything possible should be done to assist in helping these thousands of innocent Americans who have been falsely prosecuted and imprisoned in our country.I would not hesitate one minute to vote for federal funding for the Innocence Project, or any other US organization willing to get involved in correcting this nightmare of an injustice.

If this kid Manny Gonzales does not get legal assistance for his federal appeal, I read he will have to attempt to represent his own legal case himself from his prison. How could our US judicial federal appeal process not have changed since the 1800's to make this
situation fair for all Americans to be able to use properly? It is quite obvious that being a innocent and poor prison inmate in an American prison serves no real opportunity for a possible chance to be granted a new criminal retrial as compared to a guilty and wealthy prison inmate has. How many more OJ Simpson legal cases does our US Congress need before they understand the impossible task poor folks have to receive justice in this dire situation? This very clear example of the vast false incarceration in the 1800's that continued to be used against black Americans in the 1800's down South, is still ingrained in our federal appeal judicial process??? When the federal government can't receive a properly formulated and written appeal on a poor prison inmates state criminal trial, the expected results of their retrial review being denied should not come as a surprise to anyone in our US Congress because it has been allowed to continue for at least 150 plus years and counting.

I have a serious problem with a judicial system that continues to allow our reported 100,000 innocent US prison inmates to be denied proper legal representation for their equal opportunities at being granted a new criminal trials with their federal appeals.How this country can still have this injustice ingrained in our judicial system and continue on even after all the damage it caused in the 1800's with black Americans being falsely incarcerated in the Southern states and unable to properly use the federal appeal process due to lack of educational skills,is shocking.

The Manny Gonzales international financial appeal issue being posted on the WWW asking President Hugo Chavez of Venezuela for the needed finances to pay for this kids federal appeal legal fees, should be a major concern for all in our judicial system ! When a 21 year old kid who just aquired his GED in prison is forced by our judicial system to attempt to defend himself properly in our federal appeals court judicial process,we all have to really wonder why our great country has come so far in certain areas of our wonderful society,and has decided to stay locked into this same injustice that enabled the South to continue to falsely imprison so many innocent black Americans without being able to receive help from the Federal courts?

It's a very tragic situation our country faces today concerning our US Congress and judicial systems attitude towards this 100,000 falsely prosecuted and incarcerated prison inmates in America!It is a widely known and sad fact,that federal appeal retrials are only being granted to those fortunate enough to have proper legal counsel available to work on their legal appeal cases.Since our US Congress has never offered lawyers to assist poor Americans with their federal retrial appeals,tens of thousands of defendants without this needed legal counsel are never having any chance of being granted new retrials by Federal judges.Many in our US government are willing to accept the reality that 5% of this poor prison inmate population that is being denied federal appeal legal representation is innocent and also will never have their equal opportunities of being granted a new state retrials on their legal cases.Since most Americans are aware that our US judicial process can never become perfected enough to always get the right defendant,it might be a very good back up policy for our government to begin to employ specialists who can locate and exonerate this innocent 5%(100,000)who have been wrongfully imprisoned due to all various sets of cicumstances.

I would have to agree with the advocates who are
pushing for all US poor prison inmates rights to be properly represented with legal counsel in the federal appeal judicial process.We all should of learned from our dark past American history of denying innocent black Americans their equal opportunities of federal retrials when they were being wrongfuly enslaved all through our Southern states.Manny Gonzales does not deserve to remain in prison 27 years because he might not be is not his own best attorney at writing his own federal retrial appeal legal case.

I have found this web site to be most informative!So glad the federal appeal judicial process is being talked about on a national level.Manny Gonzales and Timothy Atkins both being American citizens who were denied federal retrial appeal legal counsel says much about what is happening nationwide in this judicial area.
I agree with the comment that our US Congress is continuing with their vane attempt to offer all Americans equal justice under the law on the cheap!If we can afford a trillion dollar war,we should be able to afford proper legal representation for our poorer citizens federal appeals!

The most deceptive and devious means of keeping certain groups of American citizens falsely imprisoned,is to simply deny them federal appeal legal counsel ! Black Americans have been dealing with this 100 year old injustice ever since they were being railroaded into prisons all throughout our deep Southern States. Poor American prison inmates being forced to submit their own federal appeal legal cases,has become the longest continued injustice in the American judicial System! Quietly falsely incarcerating 100,000 innocent American prison inmates could really only be accomplished by the neglect or cooperation of our US National Media. Timothy Atkins and Manny Gonzales are two prime examples of US poor prison inmates nationwide,who have been denied their legal counsel for their Federal Appeals.Timothy Atkins spent 22 years falsely imprisoned in CA (never being afforded a federal appeal lawyer) and Manny Gonzales is facing 24 more years in prison if his self written federal appeal fails.

Our US Congress needs enlightenment concerning this unjust judicial process for our our poor!
I think our US judicial system has much to offer Fidel Castro of Cuba and President Hugo Chavez of Venezuela in the prison enslavement arena! It has become too easy for this unjust devious judicial process (lack of legal counsel provided poorer American prison inmates for their federal appeal legal cases) to be inflicted on our poorer citizens without the masses of other Americans even being aware that this injustice is happening! Our government knows very well how to pretend to be offering real justice to our poorer citizens,but they also must employ many experts at keeping this human enslavement issue off the national and international media radar screen! Our country according to the prison experts has 100,000 innocent and falsely imprisoned American citizens being held captive nationwide without the least bit of protest from the American general population!Our US Congress is not correct in their thinking,what the American public doesn't know won't hurt them!

What we have here in this Manny Gonzales criminal case is a jury, judge and DA taking care of their communities safety from gangs in a typical vigilante hang him high process. The presiding judge tells both attorneys (defense and prosecution ) prior the trial that this specific case is not gang related and advises the DA to instruct their witnesses not to mention or insinuate gang association information to the jury. At this point in this trial the presiding judge is aware of and protective of the defendants rights to a fair trial, knowing darn well that if a La jury is lead to believe ( rightly or wrongly ) a defendant is affiliated with a gang that a fair trial is almost impossible. What happens when this DA decides to use gang association (over the judges denials ) on this jury is really quite devious. LA judges are allowing these type of unjust trials to continue knowing these defendants can appeal for a new trial from prison after they lose their jury trials. Local DA's know this local judicial system will not dismiss a jury due to DA's using gang association with defendants and they have a free hand to play their jury to the max. This play acting between the presiding judge pretending to protect the defendants right to a fair trial and the devious DA who wants to protect our society by taking justice into their own hands is a little what Manny Gonzales and his public defender had to deal with. Any judge that allows a rouge Da to disobey their specific orders on misleading their jury into believing the defendant is either a gang member or the specific crime is gang related should have the common sense and decency to dismiss the jury and call for a new trial. This kid Manny Gonzales tried as an adult needed this judge not just to set the guidelines in the start of the trial with this rouge DA,but also to continue to protect the defendant with his right to a fair trial throughout the entire trial. When this presiding judge allowed this trial to continue the jury believed both the DA and the judge that Manny Gonzales was a gang member and this specific shooting incident was not related to his affiliation with gang activity. Every night during this two week trial this jury went home and had the opportunity to watch gang violence reported on their nightly news. How could anyone think Manny Gonzales and with his public defender in tow could defeat a presiding judge, rouge DA,and a inflamed jury with possible nightly exposure to gang TV violence ?

The prison experts have reported that there are

It appears that the US Supreme Court way back in 1984 knew the injustice of our federal appeal retrial review process really only being available for affluent Americans to get benefit from.
The masses of poor and mostly uneducated prison inmates who are being forced to write their own federal appeal legal cases, are being denied new trials by the federal courts in mass all across this country everyday.
Some believe this injustice stems way back in our history to pre Civil War era when the US Southern States were railroading blacks into prolonged prison sentences and knowing all along that the Federal Courts would never grant these poor black prison inmates new trials because they never could properly write their own federal appeal legal cases.
The real horror here is that this form of injustice is even in 2008 assisting in the prolonged false incarceration of over 100,000 innocent mostly uneducated American prison inmates nation-wide.
We all know the federal appeal retrial process was designed for all Americans as a fail safe device that every American should be entitled to utilize, but it is quite obvious that our government has allowed this appeal process to slip into a completely new facade in which it has become an exclusive opportunity for only rich Americans to be able to properly benefit from.

POORER AMERICANS NEED THE WORLD'S COURT HELP !
INTERNATIONAL COMMUNITY BEING ASKED FOR RESCUE:
I hate to say it, but I do believe that this injustice that our US judicial system has been inflicting on the tens of thousands of our Middle Class and Working Poor Amercans (who are the least educated US prison inmates) with prolonged incarceration, is a very realistic human rights violation if not a crime against humanity issue.
The International World Court and United Nations should be investigating why only wealthy Americans are able to receive federal retrials using proper legal representation and US poorer prison inmates are forced to be their own best lawyers from prison and failing in mass at their opportunities for federal retrial reviews.
Our judicial system just recently released 360 men who spent 25 to 40 years being incarcerated for rapes they never committed! Had these judicial victims been given appeal attorneys for their federal appeal reviews, just maybe they might have been given retrials and not have had to wait until DNA evidence exonerated them decades later.
Until our judicial system becomes so perfected to always accurately charge and convict the right individuals with crimes,we all have to stay focused on preserving every legal opportunity for the truly innocent to be able to rise up and out of our cold hearted prison system that treats everyone in their grasp as guilty equals.

**What we have here in this Manny Gonzales criminal case is a jury,judge and DA taking care of their communities safety from gangs in a typical vigilante hang them high process.The presiding judge tells both attorneys(defense and prosecutor)prior the trial that this specific case is not gang related and advises the DA to instruct their witnesses not to mention or insinuate gang association information to the jury.
** At this point in this trial the presiding judge is aware of and and protective of the defendants rights to a fair trial,knowing darn well that if a LA jury is lead to believe (rightly or wrongly)that a defendant is affiliated with a gang that a fair trial is almost impossible. What happens next when this DA decides to use gang association (over the presiding judges orders and objections)on this jury is really quite devious.LA judges are allowing these type of unjust trials to continue knowing these defendants can appeal for a new trial from prison after they lose their jury trials.
** Local DA's know this local judicial system will not dismiss a jury due to DA's using gang association with defendants and they have a free hand to play their jury to the max.This play acting between the presiding judge pretending to protect the defendants right to a fair trial and the devious DA who wants to protect our society by taking justice into their own hands,is a little what Manny Gonzales and his public defender had to deal with.

When this presiding judge allowed this trial to continue, the jury believed both the DA and the judge that Manny Gonzales was a gang member and this specific shooting incident was not related to his affiliation with gang activity.
**Every night during this two week trial this jury went home and had the opportunity to watch gang violence reported on the nightly news.How could anyone think that Manny Gonzales and his public defender in tow could defeat a presiding judge,rogue DA and a inflamed jury with nightly exposure to gang TV violence?

I’m a little late on writing about this story (via several sources), but it sure is a doozy.
You know how it’s common knowlege that most appeals aren’t successful? Well, if you were a pro-se petitioner in Louisiana for the last 13 years, you knew that you wouldn’t win. Why is that? Because the Chief Judge of their Court of Appeals directed his clerk to summarily deny all appeals from pro-se petitioners without circulating the appeal to other judges.
The clerk, ridden with guilt, committed suicide earlier this year and left a note confessing everything.
This immoral and apparently illegal policy was in place until Jerrold Peterson, the staffer charged with implementing it, blew his brains out in May of last year. Peterson was driven to it in part, his suicide note suggested, by guilt over the nefarious tasks the judges made him perform.
In his note Peterson explained how the court gave indigent appellants the bum’s rush.
Although every criminal writ application is supposed to be reviewed by three judges, he was deputed to winnow out any that had been filed pro se and arrange for their automatic rejection.
Thus were an estimated 2,500 appeals deep-sixed without any judicial consideration whatsoever.
Now, facing public embarassment and possible ethical violations, the Louisiana Supreme Court has stepped in and asked…get this…the same appellate court to look at the appeals again. Note that they did not ask the Court to conduct an investigation into this practice, but simply to consider those appeals that were so summarily denied.
Because, if we placate the defendants with another cursory look at their appeals, we can sweep the ethical violations under the carpet.
At first this whole thing seemed rather odd to me. After all, how is this even possible? Here’s how:
Edward Dufresne, Chief Judge of the Fifth Circuit, took charge of pro se appeals in 1994. He then had Peterson prepare rulings denying writs for all of them and signed off “without so much as a glance,” according to the suicide note. “No judge ever saw the writ application before the ruling was prepared by me,” Peterson wrote in a second suicide note to the Judiciary Commission.
The rulings also bore the names, though not the signatures, of judges Marion Edwards and Wally Rothschild. Neither Edwards nor Rothschild had any clue as to what was in the applications, or even knew that they had been filed, according to Peterson.
So you’ve got one complicit judge and maybe three. But there are 5 more on that court. What of them? Are we to really believe that these 5 (or 7) other judges never once questioned the stark absence of pro-se appeals? Particularly in Louisiana, whose system has the following characteristics:
* About 90 percent of criminal defendants in Louisiana are indigent.
* Louisiana only provides post-conviction legal aid in death penalty cases. Everyone else must either hire a lawyer, find a lawyer to handle their case pro bono, or handle the appeal themselves. Obviously, most have no choice but to opt for the latter.
* One criminal defense lawyer in Louisiana told me that if you’re convicted of murder in Louisiana and you’re innocent, you’re actually better off getting the death penalty. At least then you’ll get a team of lawyers, investigators, and experts to help with your appeal.
This from a state whose criminal justice system was already crumbling. It’s hard to believe that people such as Judge Dufresne take an oath to uphold the law and to prove equal protection under it. Disbarment may be enough, but only barely.
Justice delayed is no justice at all.

This immoral and apparently illegal policy was in place until Jerrold Peterson, the staffer charged with implementing it, blew his brains out in May of last year. Peterson was driven to it in part, his suicide note suggested, by guilt over the nefarious tasks the judges made him perform.
In his note Peterson explained how the court gave indigent appellants the bum’s rush.
Although every criminal writ application is supposed to be reviewed by three judges, he was deputed to winnow out any that had been filed pro se and arrange for their automatic rejection.
Thus were an estimated 2,500 appeals deep-sixed without any judicial consideration whatsoever.
Now, facing public embarassment and possible ethical violations, the Louisiana Supreme Court has stepped in and asked…get this…the same appellate court to look at the appeals again. Note that they did not ask the Court to conduct an investigation into this practice, but simply to consider those appeals that were so summarily denied.
Because, if we placate the defendants with another cursory look at their appeals, we can sweep the ethical violations under the carpet.
At first this whole thing seemed rather odd to me. After all, how is this even possible? Here’s how:
Edward Dufresne, Chief Judge of the Fifth Circuit, took charge of pro se appeals in 1994. He then had Peterson prepare rulings denying writs for all of them and signed off “without so much as a glance,” according to the suicide note. “No judge ever saw the writ application before the ruling was prepared by me,” Peterson wrote in a second suicide note to the Judiciary Commission.
The rulings also bore the names, though not the signatures, of judges Marion Edwards and Wally Rothschild. Neither Edwards nor Rothschild had any clue as to what was in the applications, or even knew that they had been filed, according to Peterson.
So you’ve got one complicit judge and maybe three. But there are 5 more on that court. What of them? Are we to really believe that these 5 (or 7) other judges never once questioned the stark absence of pro-se appeals? Particularly in Louisiana, whose system has the following characteristics:
* About 90 percent of criminal defendants in Louisiana are indigent.
* Louisiana only provides post-conviction legal aid in death penalty cases. Everyone else must either hire a lawyer, find a lawyer to handle their case pro bono, or handle the appeal themselves. Obviously, most have no choice but to opt for the latter.
* One criminal defense lawyer in Louisiana told me that if you’re convicted of murder in Louisiana and you’re innocent, you’re actually better off getting the death penalty. At least then you’ll get a team of lawyers, investigators, and experts to help with your appeal.
This from a state whose criminal justice system was already crumbling. It’s hard to believe that people such as Judge Dufresne take an oath to uphold the law and to prove equal protection under it. Disbarment may be enough, but only barely.
Justice delayed is no justice at all.

The idea that we should furnish the poor with a public defender has been an effort to save our nation from shame – for sending the poor to prison without adequate representation. But today the nation’s public defender system has become a mockery of justice.
To provide an accused with a public defender who has three hundred other cases to defend is simply to laugh in the face of both justice and the accused himself. It takes me months to prepare the average criminal case for trial. The trial itself can take weeks, even months.
While O.J. Simpson was being tried in Los Angeles for murder, a case that cost millions to defend and months to conclude, another black man was being tried in the same courthouse for a similar murder. It took only three days for a jury to find him guilty. He had a public defender with scores of other cases to defend. Many prosecutors boast that they have over a 90 percent conviction rate. Little wonder. Under the present public defender system the prosecutors should enjoy one hundred percent convictions, and many in fact approach perfect conviction rates.
The public defenders in seven states have finally refused to take on any new cases. It’s about time. If I walked into court to defend my client and had never talked him, never previously opened his file, never discovered the witnesses against him, much less interviewed them, never reviewed the evidence in the hands of the prosecution, never demanded my clients rights to discovery, never read the cases relevant to the case at hand, never prepared the cross examination of the witnesses against my client, never …and on and on, I would be guilty of legal malpractice.
Every public defender who purports to represent an accused under circumstances in which he or she has neither the time nor the resources to fully defend the client is guilty of malpractice. These public defenders cannot be saved from malpractice because they are crushed under a ridiculous case load – some with even as many as five hundred cases or more. No one who was accused with such an attorney has received a fair trial and every such accused is entitled to an appeal on that basis alone. The judge must not sentence the accused under these circumstances because the judge would be taking part in a fraud on the system. Yet hundreds of thousands of indigent persons go to prison each year under circumstances no better than those outlined above.
When I was coming up as a young prosecutor, the defendants were represented pro bono by the lawyers in the local bar. It was part of the duty of members of the bar to take part in the justice system. Today that idea is unheard of. The practice of law is first and foremost a money-making profession. I see nothing wrong with that notion, but what about giving back?
Every trial lawyer should be required to take on a couple of pro bono cases every year. At our office we have a separate pro bono law firm and have for over ten years. It often brings us more satisfaction than our big money wins. The job of a lawyer is to represent the people – the lost, the forgotten, the damned, the hated, the voiceless and the poor. Indeed, God forbid, we may one day become one of those who are entitled to representation but cannot afford it.
Every time an accused goes to prison without having received a fair trial we are one step closer to the loss of our own freedoms. Our rights are, in fact, being fought for by public defenders who can never fulfill their duty to their clients because of their pathetic, impossible, caseloads. When they fail, we are in danger. Our system becomes a hypocritical charade. And we prove, once and for all, that the promised justice for all in America is an evil lie that is imposed on the poor.
If only those with money can receive justice, then how can we permit our children to recite a horrible falsehood in school when they chant, “with liberty and justice for all.” That can no longer be the truth in America.
