New York state sentencing of former Prez Trump delayed until September 18, 2024

As reported in this Fox News piece, "Judge Juan Merchan has delayed former President Trump's sentencing in New York v. Trump to September, after requests from the presumptive Republican nominee to do so, and no opposition from Manhattan District Attorney Alvin Bragg." Here is more:

Trump on Monday moved to overturn his criminal conviction in the Manhattan case after the U.S. Supreme Court ruled that a former president has substantial immunity for official acts committed while in office. He also requested to delay his sentencing, which was set for July 11 — just days before the Republican National Convention where he is set to be formally nominated the 2024 GOP presidential nominee.

Bragg, on Tuesday morning, said Trump's request to toss the verdict was without merit, but did not oppose the request to delay sentencing. Merchan on Tuesday afternoon delayed Trump's sentencing date to Sept. 18 at 10:00 a.m.

"The July 11, 2024, sentencing date is therefore vacated. The Court’s decision will be rendered off-calendar on September 6, 2024, and the matter is adjourned to September 18, 2024, at 10:00 AM for the imposition of sentence, if such is still necessary, or other proceedings," Merchan wrote in a letter to Trump attorneys and New York prosecutors.

Trump is apparently making an argument that Bragg used some evidence of Trump's official acts--what would those be?

I read a good chunk of the transcript, and I am clueless at what Trump's official acts might be. He signed off on the documents while he was president, but they were his personal business accounts.

At this point, it appears that Trump's attorneys have merely asked for leave to file the motion and have not identified the specific evidence which they now claim was improper. I'll be interested in seeing what evidence they claim was improper, but nothing leaps to my mind as significant enough to get him a new trial. Since Judge Merchan is only postponing sentencing by two months and this claim does not appear to be as strong as the arguments that Trump already has, I think Trump's attorneys probably made a mistake here as a September sentencing hearing is worse for Trump than a July sentencing hearing.

yeah, I don't recall any official acts evidence introduced. The whole case was a farce. I hope that Trump gets elected and figures out a way to get all of these guys imprisoned for a very long time.

I think that, at the end of the day, Merchan is going to hold the sentence in abeyance until all appeals are final. The Supreme Court is not going to allow him to be imprisoned during the campaign.

If you're right, as I'm inclined to think you are, Merchan should just have denied the motion and proceeded with sentencing on the original date. It would hardly be the first Trump motion he's denied.

I think it was a clever move for a politically ambitious man. Mayor? Governor? Who knows.

On the other hand, selecting a defendant because you have political ambition goes against everything I ever learned about how the first step in prosecutorial discretion is integrity. Bill, I think what is going on here is bending over backwards to avoid an appellate issue.

Federalist, I don't know New York law. In my state, there is no right to appeal until after sentence is imposed.

Tmm, I don't understand what youre responding to.

It's amazing what a farce this case is. I think Merchan will impose a term of incarceration, but stay that that pending appeals. If he tries to impose limits on Trump traveling, he risks intervention by a federal court.

I sincerely hope that Trump figures out a way to settle scores with all of them. From Strzok to Merchan and everyone in between.

I'm not a lawyer; I, for one, don't wish to live in a country where the leader respects Dictators, hates Freedom, and will prosecute everyone with whom he disagrees (Putin) and wants to emulate Hitler.

Remember, the 2024 election is not only about who will hold the office in January, but who will hold it FIVE January’s from now.
