The Kentucky case reads like a long shot. Statutory habeas is not the same thing as constitutional habeas. The mere fact that there is a judgement from a court of competent jurisdiction is enough to satisfy constitutional habeas.
That federal court judges wish these cases came out differently is most of the point of AEDPA.
